Same-sex marriage in India Same-sex marriage is a union between two people of the same gender. It is a topic of debate in many countries, including India. In India, same-sex marriage is not yet legal. However, in November 2022, two same-sex couples moved the Supreme Court, arguing that their inability to marry under Indian family law amounted to a violation of their fundamental rights to equality, life and liberty. The Supreme Court dismissed the petitions and refused to recognize same-sex marriages in India. The government has consistently opposed the recognition of same-sex marriage, calling it an urban elitist concept and arguing that it is up to Parliament to decide and debate this issue.
